Terms

Any work undertaken by Prodoto Photographic Studios Ltd. shall be subject to the following Terms & Conditions:

1. Turnaround Times

All orders have to be confirmed before 10am to guarantee our turnaround times. Turnaround times are counted on working days only.

2. Pricing

Items considered by Prodoto to be too large or too heavy are to be quoted separately.

3. Pick Up & Return Service

Pick up and return charges nationally are quotes for packages up to 31kg and no larger than 57 x 57cm. An increase in weight or size will incur extra costs.

4. Our Service

The service Prodoto provides can be withdrawn at any time.

5. Paying for your Photography

Images provided by Prodoto will be delivered online upon receipt of cleared payment using credit card or PayPal. Final images will not be released before full payment has been received. Clients wishing to discuss alternative payment terms should contact us to speak with a member of our accounts team. All prices are exclusive of VAT, which will be charged at 20%.

6. Receiving your Images

Once cleared payment has been received the images will be made instantly available online and also sent out on a CD or DVD. You will be provided with a unique User Name & Password to access your images from our Client Login area, which is totally secure. You may request to change your login details at any time.

7. Refund Policy

Images are presented to our clients online for approval following the shoot before payment is requested. Based on this approval system, we cannot offer refunds against our photographic images after the images have been approved and payment has been made.

8. Cancellation

If a booked photography slot in our studio is cancelled by our client, the studio requires a minimum of 24 hours notice. Failure to do this will result in a penalty of 25% of the total quoted price for the job payable to Prodoto Photographic Studios Ltd.

9. Privacy Policy & Client Confidentiality

Prodoto Photographic Studios Ltd. respects your privacy. When you pay for your images using your credit card, we do not retain this information in any form. Following your successful payment transaction, your details are destroyed. Prodoto do not pass any details on to any third party and all of our clients contact details are kept securely, remain confidential and are never shared, disclosed or given out.

10. Insurance Details

Whilst our clients’ products are at our studio, there is a degree of insurance coverage provided. If additional insurance is required for more valuable items or if the level of insurance cover is a concern, additional arrangements can be discussed and arranged with us upon request.

Whilst in transit either to or from our studio, our clients’ products should be covered by the insurance provided by the courier tasked with transporting the goods, and it is the client’s responsibility to ensure that the insurance is sufficient to cover the goods transported. Prodoto Photographic Studios Ltd. will accept no responsibility for products lost or damaged in transit, to or from our studios.

11. Photography Brief

Photography will commence following acceptance and mutual understanding of a written or verbal brief provided by our clients. Re-shoots of rejected photographic images will be chargeable if Prodoto Photographic Studios Ltd. has adhered to the brief and our client makes changes to the brief after the images have been shot. Specific instructions about how you wish the products to be photographed must be made clear to Prodoto.

12. Image Copyright

Prodoto Photographic Studios Ltd. retains copyright on all images supplied to our clients. However, our photography is supplied with an ‘All Uses’ license, covering UK advertising, POS, catalogue, magazine, brochure and web use, for 1 year. Additional Usage Rights can be negotiated as required. In the event of a client defaulting on an invoice Prodoto Photographic Studios Ltd. reserve the right to revoke the ‘All Uses’ license and to pull copyright without notice.

13. Unpaid Invoices

If payment is not made by the due date or in accordance with our clients’ specific payment terms & conditions, we reserve our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation.

A fee of £20 (excluding VAT) will be made for each account reminder, duplicate invoice, or any other correspondence, paperwork or phone call involved with the recovery of a debt / unpaid invoice. This is non-refundable and represents time spent pursuing overdue invoices.

In addition, in the event of an unpaid invoice, Prodoto Photographic Studios Ltd. reserve their right to revoke all discounts relating to the job for which the invoice remains unpaid, making them null & void and to revert to our full standard pricing structure appropriate to the job.

14. Incorrect goods delivered / shortages.

All products supplied to Prodoto must be in the condition in which they are to be photographed. In the event of short deliveries, damaged goods or incorrect items received from our clients, Prodoto Photographic Studios Ltd. reserve the right to postpone the photo shoot until the shortage is made-up, the correct products are delivered or damaged items replaced. A penalty of 10% of the total quoted price for the job may be payable to Prodoto.com should our studio schedule be affected by the above, resulting in loss of profit or studio down-time.

15. Force Majeure

Prodoto Photographic Studios Ltd. shall have no liability to the client if it is prevented from or delayed in providing its service by acts, events, omissions or accidents beyond its reasonable control, including failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or sub-contractors.
